1. Agreement
By accessing or using Markah at markah.my, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the service. Markah is operated by Niskala, Kuala Lumpur, Malaysia.
2. Description of Service
Markah is a web-based AI tool that assists teachers in grading handwritten English essays for Malaysian secondary school examinations, including SPM English 1119/2 and PT3 English. The service performs optical character recognition (OCR) on essay photos and generates AI-assisted criterion scores and feedback aligned with official rubrics.
3. Eligibility and Permitted Use
Markah is intended for use by:
- Secondary school English teachers in Malaysia
- Tuition teachers and private educators
- School administrators involved in assessment
You may not use Markah to:
- Resell or sublicense access to third parties
- Reverse-engineer or scrape the platform
- Upload content that is illegal, abusive, or violates third-party rights
- Attempt to circumvent usage limits or authentication systems
4. Free Tier and Usage Limits
Markah offers a free tier subject to the following limits:
- Bonus essays: 30 essays credited on account creation, with no time limit.
- Monthly allowance: After the bonus is exhausted, 10 essays per calendar month, resetting on the 1st of each month.
We reserve the right to modify these limits at any time with reasonable notice.
5. AI Disclaimer and Accuracy
Markah uses artificial intelligence to assist with essay grading. AI-generated scores and feedback are advisory only. The teacher retains full professional responsibility for all final marks awarded to students. Markah does not guarantee the accuracy, completeness, or suitability of any AI-generated output for official examination purposes.
You acknowledge that AI scoring may contain errors and agree not to rely solely on Markah's output for high-stakes assessment decisions without independent review.
6. Account Responsibilities
You are responsible for maintaining the security of your account credentials. Do not share your login details. You are responsible for all activity that occurs under your account. Notify us immediately at contact@niskala.my if you suspect unauthorised access.
7. Intellectual Property
The Markah platform, including its software, design, rubric implementations, and branding, is the property of Niskala. Essay content uploaded by users remains the property of the respective teacher or institution. By uploading essay photos, you grant Markah a limited licence to process the content solely for the purpose of providing the grading service.
8. Limitation of Liability
Markah is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by Malaysian law, Niskala shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to errors in AI-generated grades, data loss, or service interruptions.
9. Termination
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused. You may close your account at any time by contacting contact@niskala.my.
10. Changes to Terms
We may update these Terms from time to time. Continued use of Markah after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
